Terms of Service

These Terms of Service ("Terms") govern your access to and use of TokonLab's API services, website, and related products (collectively, the "Services") provided by TokonLab, Inc. ("TokonLab," "we," "us," or "our"). By using our Services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use our Services. By using our Services, you represent that you meet these requirements.

2. Account Registration

You must create an account to access our API. You are responsible for maintaining the security of your account credentials and API keys. You must notify us immediately of any unauthorized use of your account.

3. Acceptable Use

You agree not to use our Services to:

• Generate content that is illegal, harmful, threatening, abusive, or defamatory
• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Attempt to reverse engineer, decompile, or extract model weights
• Engage in automated abuse, scraping, or denial-of-service attacks
• Resell or sublicense access to our Services without written permission
• Generate CSAM or any content that exploits minors

4. API Usage and Rate Limits

Your use of the API is subject to rate limits and usage quotas as described in our documentation. We reserve the right to throttle or suspend access if usage exceeds reasonable limits or violates these Terms.

5. Billing and Payment

You agree to pay all fees associated with your account. Fees are charged based on token usage as described on our pricing page. All fees are non-refundable except as required by law or as explicitly stated in our refund policy. We reserve the right to change pricing with 30 days' notice.

6. Intellectual Property

TokonLab retains all rights to our platform, software, and documentation. You retain ownership of content you submit through the API. You grant us a limited license to process your content solely to provide the Services.

7. Third-Party AI Providers

Our Services route requests to third-party AI model providers. These providers have their own terms of service and acceptable use policies. By using our Services, you agree to comply with the terms of the underlying providers. We are not responsible for the outputs generated by third-party models.

8. Disclaimer of Warranties

Our Services are provided "as is" without warranties of any kind. We do not warrant that the Services will be uninterrupted, error-free, or that AI outputs will be accurate or suitable for any particular purpose.

9. Limitation of Liability

To the maximum extent permitted by law, TokonLab's liability for any claim arising from these Terms or your use of the Services is limited to the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason with reasonable notice. You may terminate your account at any time by contacting us.

11. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

12. Changes to Terms

We may update these Terms periodically. We will notify you of material changes via email or a notice on our website. Continued use of our Services after changes constitutes acceptance of the updated Terms.
